Liability Release & Hold Harmless Agreement

I acknowledge that participation in activities and programs, and the use of facilities at The Body Factory Health & Fitness Center, involve inherent risks of injury, illness, or other physical harm. By signing this agreement, I voluntarily assume all risks associated with my participation and/or that of my minor child(ren). I hereby release and hold harmless The Body Factory Health & Fitness Center, including its owners, employees, agents, and volunteers, from any and all claims, liabilities, demands, damages, or causes of action arising from any loss, injury, or damages sustained while participating in gym activities, programs, or use of the facility. I further agree to indemnify and hold harmless The Body Factory Health & Fitness Center and its owners, employees, agents, and volunteers from any costs, expenses, claims, or legal actions, including attorney’s fees, arising from participation in any activities or use of the facility. I understand and agree that The Body Factory Health & Fitness Center retains the right to manage and direct the defense and settlement of any claim or legal matter arising under this agreement. By signing below, I acknowledge that I have read, understood, and voluntarily agree to the terms of this Liability Release & Hold Harmless Agreement.

Gym Etiquette & Member Guidelines

To help maintain a safe, clean, and respectful environment for all members, we kindly ask that you observe the following gym policies:

• Please ensure the entrance door is fully secure after entering or exiting the gym. For safety reasons, do not allow anyone access through the 24-hour entry door. If a member’s key tag is not working, there is typically a reason, and they may contact Debbie directly using the phone number posted near the card reader.
• All members are required to scan their key tag at the exterior card reader or kiosk upon entry. Guests are not permitted through the 24-hour access entrance.
• The 24-hour access system is an exclusive benefit for active Body Factory members and is regulated under our liability insurance policy. Members who provide unauthorized access to others may be held responsible for that individual, including a $20 fee and possible suspension of membership privileges.
• If you are the last person leaving the gym, please turn off all lights and fans before exiting.
• For hygiene and comfort purposes, sports bras alone and stringer-style tops are not permitted. Members are asked to wear a T-shirt or a racerback tank top that provides appropriate coverage on shared equipment surfaces.
• Disinfectant bottles are located throughout the facility. Please wipe down equipment after use and return all weights and equipment to their proper place.
• Tripods and video recording are not permitted inside the gym.
• Please use collars and safety equipment provided while weightlifting.
• Emergency 911 necklaces are available at the kiosk for members working out alone.
• For insurance purposes, children under the age of 13 are not permitted in the workout area.
• Security cameras are in use throughout the facility to help maintain member safety and protect the gym environment.

The Body Factory reserves the right to terminate any membership agreement without refund for repeated or serious violations of gym policies.

Contract Acknowledgment & Agreement

I understand that this membership agreement is a legally binding contract for a one-year term and is non-negotiable once signed. I agree to fulfill the financial obligations for the duration of the contract term. I further understand that failure to comply will result in additional fees, suspension of membership privileges, and/or collection efforts if necessary.

By signing below, I acknowledge that I am entering into this agreement voluntarily, that I am 18 years of age or older, and that I accept full responsibility for the financial obligations under the 12-payment contract.
